1. Nature of the service
This analysis is the result of an algorithmic multi-layer process (multi-layer AI). It constitutes a purely technical and functional conformity check. It is expressly not a legal service within the meaning of the German Legal Services Act (Rechtsdienstleistungsgesetz, RDG) and does not constitute legal advice. The system does not apply the law to an individual case; it matches technical data parameters against a stored knowledge base.
2. Target audience and own responsibility
This tool is designed exclusively as an assistance system for qualified professionals (e.g. QA managers, laboratory professionals, certified food chemists). The results serve as guidance for making internal quality control more efficient. Ultimate responsibility for marketability, and for the final approval of labelling and packaging materials, remains entirely with the party placing the product on the market.
3. Mandatory verification before production starts
Before any cost-intensive follow-up step is initiated (e.g. print approval, batch production, destruction of stock), the results of the analysis must be validated by a competent natural person. Liability for consequential damages — in particular printing costs, production downtime or recall costs — arising from the unverified adoption of system-generated suggestions is excluded to the extent permitted by law.
4. Technical limitations and input quality
The precision of the analysis depends directly on the quality of the source data provided.
- Artifacts: Image noise, distortion, unfavourable lighting conditions or OCR (optical character recognition) errors can severely impair the recognition rate.
- AI variance: As this is a probabilistic system, both false-positive and false-negative results (undetected defects) can occur. Complete freedom from error is inherently not warranted.
5. Currency of the legal basis
The analysis is carried out on the basis of the data states stored in the system at the time of the query (M1/M2). No warranty is given that the most recent case law or short-notice legislative changes are reflected on a day-to-day basis.
